In incorporated cities and their ETJs, a building or electrical permit is required to install any residential battery storage system over 2 kWh. This applies to Austin, Houston, Dallas, San Antonio, Fort Worth, and every Texas city and suburb.
In unincorporated county areas, Texas Senate Bill 1252 — signed by Governor Abbott and effective September 1, 2023 — removed county authority to require permits for residential energy systems, including home batteries. Before SB 1252, many Texas counties required building permits for these installations. That county-level requirement is now gone.
The critical nuance: cities retained full permit authority. A city's ETJ extends up to 5 miles beyond its boundary for cities over 100,000 population. Practical impact: the exemption benefits homeowners on large rural acreage well outside any city's reach. It does not help the typical suburban Texas homeowner in Katy, Frisco, Cedar Park, or Allen — all of whom are within a city's jurisdiction.
